BCD takes your privacy very seriously. Please read our privacy policy carefully to understand how we collect, use, protect, and otherwise handle your Personal Information.

WEBSITE PRIVACY POLICY – U.S. and GDPR

BCD LLC and its affiliates (collectively, “BCD,” “we”, “us”, or “our”) value their customers, their information, their privacy, and their trust. This Privacy Policy (“Policy”) applies to information collected online from users of the BCD website, bcdvideo.com (the “Site”), and explains how we collect, use, and protect that information.

This Policy applies to BCD’s collection, use, processing, storage, and transfer of information associated with BCD’s Site. For the purposes of this Policy, unless otherwise noted, all references to the Site include bcdvideo.com, mobile applications, and other electronic communications between you and the Site.
This Policy is also intended to address our obligations under the General Data Protection Regulation (“GDPR”), the UK GDPR and Data Protection Act 2018, and the Swiss Federal Act on Data Protection (revFADP).

Throughout this Policy, we refer to the term “Personal Information.” “Personal Information” means data that identifies, describes, is associated with, or could reasonably be linked to an individual, such as a name, birthdate, postal address, email address, telephone number, driver’s license number, Social Security Number, other government-issued identification numbers, credit card number, or other unique identifiers.

Personal Information does not include anonymous or aggregated data that can no longer reasonably identify a specific person, even if combined with other information. We may also collect information related to businesses, companies, institutions, or other entities rather than individuals (“Business Information”). We do not consider Business Information, such as title, employer name, work email, work phone number, work address, and other similar business-related information, to be Personal Information.

Sensitive Personal Information

Some applicable laws separately regulate “sensitive” categories of Personal Information, such as Social Security Number, driver’s license number, financial account information, precise geolocation, racial or ethnic origin, religious beliefs, health information, biometric identifiers, sexual orientation, and citizenship or immigration status.

BCD does not knowingly collect sensitive Personal Information from website visitors except where you voluntarily provide it to us in a credit application or similar form. We do not use or disclose sensitive Personal Information for purposes that would require offering an opt-out under applicable state privacy laws.

Information We Collect

We collect information about you in two ways: 1) directly from you; and 2) indirectly from you through your use of the Site.

Information Collected Directly From You

When you contact us using our Site regarding our products and/or services, subscribe to our newsletter, or use the Site’s forms to apply for credit, we may collect Personal Information including your first and last name, phone number, email address, company information, and related details necessary to respond to your request or provide services to you. Although we limit access to certain pages, users should also utilize available account privacy and security settings when applicable.

Information Collected Indirectly from You

When you visit our Site, we may collect information about your visit and maintain that information in our web server logs, which are records of the activities on our Site. The servers automatically capture and store the information electronically. Examples of the information we may collect include: Internet Protocol (IP) address; browser type and language; Internet Service Provider (ISP), referring and exit websites and applications; operating system; date/time stamp of activity; clickstream data; whether you are a first-time or a returning user; links you clicked on while in the Site; and your flow and navigation path through the Site. We use this information in a de-identified or aggregated fashion to help us administer the Site, analyze usage, improve functionality, prevent fraud, protect our Site and users, and improve user experience.

In some of our email communications, we may use “click-through URLs” linked to content on our Site. We may track click-through activity to measure engagement and communication effectiveness. If you prefer not to be tracked, do not click those links.

Cookies

We use technologies, such as “cookies,” and similar tracking tools to remember preferences, recognize returning visitors, analyze Site traffic, improve Site performance, and help protect the Site against fraud and misuse.

A cookie is a small text file stored on your device. Cookies cannot read data from your hard drive, execute programs, or transmit viruses.

We do not use cookies to intentionally collect Personal Information that you do not voluntarily provide. However, information collected automatically through cookies or similar technologies may be associated with Personal Information that you provide to us or that we receive from other lawful sources.

Website Analytics

We use third-party analytics and related services, including tools provided by companies such as HubSpot, Google Analytics, Salesforce, NetSuite, and other analytics, hosting, customer support, and email-delivery providers.

These technologies help us understand how visitors use our Site, improve functionality and security, personalize content, measure advertising effectiveness, and provide marketing communications that may be relevant to your interests.

These third parties may use cookies and automated technologies to collect information about your interactions with our Site and advertisements.

Children’s Information

Our Site is not directed to children.

We do not knowingly collect Personal Information from children under the age of 13, consistent with the U.S. Children’s Online Privacy Protection Act (“COPPA”). We also do not knowingly process Personal Information of minors under 16 for purposes of targeted advertising, sale, or profiling in a manner restricted by applicable U.S. state privacy laws.

Use of Personal Information

We only use your Personal Information for the original purposes it was given and to further our legitimate business interests, such as to transact business, to provide information about our company and products, and to communicate with Site visitors. Personal Information is also used to provide you with a more enjoyable, convenient online experience. Access and Consent to Use Your Personal Information

If you do not consent or want to withdraw your consent for us to collect, use, or disclose your Personal Information as described in this Policy, please use the contact information provided in the “Questions and Contact Information” section. In your request, please identify the Personal Information at issue and the collection, use, or disclosure you wish to stop.

Denying or withdrawing consent may not allow us to provide you with some or all the products, services, or information you request.

You may opt-out of receiving marketing-related emails, targeted advertising messages, or promotional offers from BCD by clicking the “unsubscribe” link at the bottom of any email you receive from us or emailing us at marketing@bcdinc.com.

If you opt out from receiving marketing emails, we may still need to send you communications about your account, orders, customer service inquiries, and other matters. If you agreed to receive future marketing communications directly from a third party through our Site, you would need to contact that party to opt-out of such communications. This process may be outlined in that party’s privacy policy. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website.

U.S. State Privacy Rights

We will respond within 45 days of receipt of a verifiable request, with one extension of up to 45 additional days where reasonably necessary and will notify you of any extension within the initial response period.

Verification. To protect your information, we may need to verify your identity before fulfilling a request. We may ask you to provide information that matches information already in our records.

Authorized agents. You may use an authorized agent to submit a request on your behalf, where permitted by your state’s law. We may require the agent to provide proof of authorization and may require you to verify your own identity.

Non-discrimination. We will not discriminate against you for exercising your privacy rights.

Right to appeal. If we decline to act on your request, you may appeal that decision by emailing privacy@bcdinc.com with the subject line “Privacy Request Appeal.” We will respond to your appeal within the timeframes required by your state’s law. If you are dissatisfied with our response, you may contact your state’s Attorney General.

Global Privacy Control. Where required by applicable law, we honor the Global Privacy Control (GPC) browser signal as an opt-out of “sale” or “sharing” of Personal Information for cross-context behavioral advertising.

California “Shine the Light.” California Civil Code §1798.83 permits California residents to request information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, contact privacy@bcdinc.com.

European Economic Area, United Kingdom, and Switzerland

The following section, in conjunction with the information above, describes BCD’s data practices in accordance with the GDPR. For UK residents, references to the GDPR include the UK GDPR and Data Protection Act 2018. For Swiss residents, references include the Swiss Federal Act on Data Protection (revFADP).

Legal Basis of Processing

We will only process the Personal Information subject to the GDPR as it is described in this Privacy Policy if we have a lawful basis for doing so.

Individuals have given their consent for one or more specific purposes. Note: Under some jurisdictions, Personal Information may be processed until the individual objects to such processing (“opt-out”), without having to rely on consent or any other of the following legal bases. This, however, does not apply, whenever the processing of Personal Data is subject to United Kingdom and European data protection laws;

Provision of Personal Information is necessary for the performance of an agreement and/or for any pre-contractual obligations thereof;

Processing is necessary for compliance with a legal obligation;

Processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in BCD; and

To rectify inaccurate Personal Information and, considering the purpose of processing the Personal Information, ensure it is complete (right to rectification);
To erase/delete your Personal Information, to the extent permitted by applicable data protection laws (right to erasure; right to be forgotten);
To restrict our processing of your Personal Information to the extent permitted by law (right to restriction of processing);
To transfer your Personal Information to another controller or processor, to the extent possible (right to data portability);

Timeframe for Responding to Requests

BCD will respond to your request within thirty (30) days of receipt. Where permitted by applicable law, this period may be extended by up to two additional months where necessary, taking into account the complexity and number of requests.

Fee

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.

Security of your Personal Information

We are committed to protecting the information we receive from you. We take appropriate security measures to protect your information against unauthorized access to or unauthorized alteration, disclosure or destruction of data. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we maintain appropriate physical, electronic, and managerial procedures to safeguard and secure the information and data stored on our system. BCD uses industry-standard encryption technologies, including TLS (Transport Layer Security), to help protect transmitted information. However, no system can guarantee absolute security.

Our Site may contain links to, or advertisements about, non-BCD websites. Other sites may also reference, advertise, or link to the BCD Site. You may be able to post content to third-party Social Networking Sites on which we maintain a presence. If you choose to do this, we will provide information to the Social Networking Site(s), and receive information from them, in accordance with your elections. You acknowledge and agree that you are solely responsible for your use of those websites and that it is your responsibility to review the applicable terms of use and privacy policies. We are not responsible for the privacy practices, availability, accuracy, content, products or services of third-party Social Networking Sites.

While you are using the Site, you may be linked or directed to other third-party websites that are beyond our control. These third-party websites may have privacy policies and terms of use that differ from ours. Please carefully review these policies. We are not responsible for any actions or policies of such third parties.

Retention and Accuracy of Personal Information

We do our best to ensure that the Personal Information we hold, and use is accurate. We rely on the individuals we do business with to disclose to us all relevant information and to inform us of any changes. Personal Information is kept only for so long as is required, in accordance with our records retention policy and legal and regulatory requirements. If Personal Information is no longer required, we destroy it or render it anonymous. We retain Personal Information for the period reasonably necessary to fulfill the purposes for which it was collected, including to provide our products and services, to comply with applicable legal, accounting, tax, or reporting obligations, to resolve disputes, and to enforce our agreements. Where we no longer need to use your Personal Information, we will delete or anonymize it from our systems.

BCD strives to comply with all applicable data privacy regulations, including those of the General Data Protection Regulation set forth by the European Union and European Economic Area. Our goal is to be transparent and lawful in our collection and use of personal data. This means we intend to be open and honest about our intentions for collecting personal data and will only collect the minimum amount of data needed to fulfill our purpose. We also maintain full accountability for the data we collect and process. Once collected, we may maintain your Personal Information on computers and servers located outside of your state of residence, country, or economic region.
